Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Dash2Grow ("Dash2Grow", "we", "us", or "our"). They govern your access to and use of the Dash2Grow website, dashboard, creator studio, checkout, and related services (the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. If you use the Service on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.

You may not use the Service if you are prohibited from doing so under the laws of your country, or the laws of the countries whereDash2Grow and its payment providers operate.

You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity that takes place under your account. Notify us immediately at security@dash2grow.com if you suspect unauthorised access.

You may close your account at any time from your security settings. We may suspend or close accounts that violate these Terms, harm other users, or expose us to legal risk.

Dash2Grow is a marketplace that lets independent creators list and sell AI prompts, agents, workflows, and related digital products, and lets buyers discover and purchase them. Dash2Grow provides the technical platform, discovery, checkout, and payout infrastructure.

Unless a listing is clearly marked as being sold by Dash2Grow, the creator - not Dash2Grow - is the seller of record for the purposes of consumer law. Dash2Grow is not a party to the sales contract between buyer and creator, but we facilitate it and enforce these Terms across both sides.

When you buy a listing, you are purchasing a licence to use the digital product as described on its listing page. Unless the listing says otherwise, that licence is personal, non-exclusive, non-transferable, and limited to your own use or use within your organisation.

You may not resell, sublicense, or redistribute a purchased listing, or use it to train a competing marketplace or model, without the creator's written permission.

Downloads may be subject to per-purchase limits shown on your purchases page. If you lose access through no fault of your own, contact support and we will help.

To sell on Dash2Grow you must (a) verify your identity through our payments partner, (b) provide accurate tax information, and (c) agree to the payment-provider terms presented during onboarding.

You retain ownership of the intellectual property in your listings. You grant Dash2Grow a worldwide, non-exclusive, royalty-free licence to host, display, promote, and deliver your listings to buyers, and to use listing titles, excerpts, and cover assets to market the Service. This licence ends when you delete the listing, except for copies retained for legal, tax, or backup purposes.

You are responsible for the accuracy of your listings, for fulfilling buyer expectations, for responding to buyer support questions in a reasonable time, and for making sure your listings do not infringe anyone else's rights.

You agree not to use the Service to:

• upload content that is illegal, deceptive, defamatory, or infringes third-party rights;
• publish sexual content involving minors, incitement to violence, or hate speech;
• circumvent security, rate limits, or access controls;
• scrape the Service in ways that harm its performance or breach these Terms;
• attempt to derive source data of other users, or bulk-export other users' content;
• use the Service to distribute malware or facilitate fraud, phishing, or spam.

We may remove content, suspend accounts, and cooperate with authorities where necessary to enforce these rules.

Payments are processed by Stripe. Prices on the Service are shown in the currency displayed at checkout and, where required, include VAT or equivalent sales tax. Dash2Grow charges a marketplace fee on successful transactions; the current fee is disclosed to creators in the studio before publishing.

Creators are responsible for their own income tax reporting.Dash2Grow collects and remits VAT on digital services where it is required by law and issues invoices accordingly.

Because most listings are digital products delivered immediately, you agree that you may lose the statutory right of withdrawal available to EU/UK consumers under the Consumer Rights Directive once download or access begins - provided you gave express prior consent at checkout and acknowledged the loss of that right.

Where the right of withdrawal still applies, EU/UK consumers may withdraw from a purchase within 14 days without giving a reason, using our contact form or by emailing support@dash2grow.com.

Beyond statutory rights, refunds are handled by the creator on a case-by-case basis (for example, if a listing is materially different from its description, or does not function as advertised).Dash2Grow may issue goodwill refunds at its discretion.

Listings frequently reference or interoperate with third-party AI models. Dash2Grow does not warrant the output of any AI system and is not responsible for content generated through the use of a listing. You must comply with the terms of the third-party AI provider you choose to use.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Dash2Grow disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any warranty or consumer right that cannot be excluded under mandatory law, including the EU consumer-rights framework.

To the maximum extent permitted by law, Dash2Grow will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid to Dash2Grow in the 12 months before the event giving rise to the claim, or (b) EUR 100. Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury caused by our negligence, or any other liability that cannot be limited under applicable law.

You agree to indemnify and hold Dash2Grow harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your breach of these Terms. This section does not apply to consumers acting outside of a trade, business, craft, or profession.

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, exposedDash2Grow or its users to legal or safety risk, or if we are required to do so by law. You may terminate this agreement at any time by closing your account. Sections that by their nature should survive termination (payments due, licences to sold content, disclaimers, liability, and dispute resolution) will survive.

These Terms are governed by the laws of [governing-law jurisdiction], without regard to conflict-of-laws principles. The courts of [venue] have exclusive jurisdiction, except that consumers resident in the EU or UK may bring proceedings in the courts of their country of residence and rely on the mandatory consumer-protection laws of that country.

EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms from time to time. When we do, we will change the "Last updated" date and, for material changes, notify you by email or through the Service at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
